Terms of service
1. WARRANTY:
Every effort is made to ensure sound material and good workmanship but this agreement implies no warranty, condition, description on our part or has been given or is to be implied from anything written in the negotiations between the parties or their representatives prior to this agreements and any statutory, or other warranty, condition, description or representation expressed or implied as to the state, quality or fitness of the goods subject to his agreement is expressly expressed. Our machines are quoted and sold under one of the 3 conditions below:
a) As is: meanings as is no warranty given or implied.
b) Checked in working order: machine to be checked in working order including all major parts required to run the machine with for overall function. Sold as is, checked in working order no warranty given or implied
c) Overhauled: all major components checked and replaced where necessary, motors and gearbox checked over, painted and checked in good working order. Should a machine or line be sold as overhauled we will offer a guarantee on the work that we have done. The time period will be agreed between Anglo Plastics Ltd and the client however in the event of any faults or non-function of parts or components Anglo Plastics will only be responsible for repair costs up to a maximum of 15% of the machines final sale value. We will not cover consumables such as temperature controllers, heater bands, thermocouples, screws and barrels and other electrical components. Anglo Plastics Ltd will at no time accept responsibility for any damage caused by operator negligence.
If we do agree to include an installation service or training service Anglo Plastics Ltd will only be obliged to provide the amount of days quoted free of charge. In the event of the work taking any longer than specified Anglo Plastics Ltd will not be responsible in any circumstances to provide any additional time free of charge and any additional time required will chargeable at our standard hourly rate. Traveling and mileage charges will also apply.
If we do not agree to provide installation or training services, this can always be arranged afterwards but will be chargeable as stated above.
2. LIABILITY
Except as herein otherwise expressly provided, we accept no liability in respect of or consequent upon any defect whether in original replacement or workmanship. Our liability does not extend to any other expenditure incurred, to damages or to loss of profits. No liability can be accepted for corrosion, misuse, ill treatment or similar hazards.
3. INDEMNITY
The buyer is to indemnify against all claims whatsoever for damages and costs against all liability in respect of any infringement of patent right resulting from compliance with the buyer instructions expressed or implied.
4. DELIVERY
Our estimated delivery dates are given in good faith and we can accept no liability should the anticipated date be exceeded.
5. QUOTATION, PRICE, PAYMENT AND TRANSFER OF PROPERTY IN GOODS
Quotations only refer to goods and articles specified therein and which are available for execution of the order when received. Prices are based on the cost of material, labour, transport and statutory obligations ruling at the date of tender or contract and may be varied by the company should these costs increase. Unless otherwise agreed all prices are strictly net Ex Works and do not included the cost of packaging, carriage, freight and insurance which will charged to or paid by the buyer. Until payment has been received in full Anglo Plastics will not allow for collection of the goods. If in exceptional circumstances delivery to the buyer has been effected prior to receiving payment in full the property shall remain vested in Anglo Plastics Ltd but the goods shall be at the whole risk of the buyer who shall keep the goods fully insured against all and every risk. The buyer will be responsible for the care and maintenance thereof and will indemnify Anglo Plastics against any depreciation in value also against any damaged caused by the buyer.
6. DESPATCH
All Anglo Plastics goods are forwarded at the buyers own risk. In case of goods for export or good sold for delivery Ex Works Anglo Plastics cannot accept responsibility for damage or delay during transit unless we have specifically agreed in writing to cover such risks by insurance.
7. PERFORMANCE, WEIGHT, MEASUREMENTS AND POWERS
Although calculated carefully all details must be considered approximate only and are not guaranteed. As these machines are 2ndhand we can never guarantee power ratings as these may have been rebuilt and changed over the years. Although we supply the customer, when available with power details it is up the customer to consult with the manufacturer determine power ratings as required.
8. LIMITATIONS OF LIABILITY UNDER WARRANTIES AND EXCLUSIONS OF LIABILITY FOR AND INDEMNITY AGAINST CONSEQUENTIAL LOSS
Notwithstanding anything in this clause contained in the case of parts of the machines or ancillary equipment not of Anglo Plastics manufacture but supplied by the Anglo Plastics with all its discretion extend such guarantee or warranty as it receives from its suppliers and shall be under no further obligation in regard thereto provided always that if the Buyer makes causes or allows any alteration or repairs to Anglo Plastics machines or ancillary equipment or parts thereof without the Company’s consent or if the defect in any machines is due to negligence or improper handling by the Buyer or to any cause outside the Company’s control, then Anglo Plastics shall be released from any responsibility or liability under clause above.
9. HEALTH AND SAFETY AT WORK ETC ACT
It is expressly brought to the buyer’s attention that any item of plant, machinery or equipment supplied by Anglo Plastics which is not new may not necessarily comply with the Health and Safety at work act or any other Acts or regulation therein governing the use of that plant, machinery or equipment in a working environment. The Buyer is hereby required to ensure that the use of any such at place of work within the UK does not contravene such relevant Act or Regulations thereunder applicable thereto.
10. CANCELLATION
The Buyer shall have no right in any circumstance to cancel the Agreement or any instalment or order thereunder without the prior written consent of the company and subject to compliance by the Buyer with such requirements (including requirements as to the payment of adequate compensations) as the company may impose as a condition of giving such consent.
11. TERMINATION
Anglo Plastics shall be entitled, without prejudice to its other rights and remedies, either to terminate wholly or in part the Agreement or any other contract with the buyer or to suspend any further deliveries under the Agreement.
If any debt due and payable by the Buyer to the company is unpaid.
If the Buyer has wrongfully failed to take delivery of any goods under the Agreement or any other contract as aforesaid.
If the buyer becomes insolvent or being a body corporate has a receiver appointed or passes a resolution for winding up or a court makes an order to that effect or being an individual or partnership makes any composition or arrangement with his or their creditors or has a receiving order made against him or her.
12. INTERPRETATION
The contract shall in all respects be construed as an English contract and in conformity with English law.
13. VAT (VALUE ADDED TAX)
We will add the appropriate rate of V.A.T when applicable to the prices quoted when rendering our invoices.
